The likeness is owned by Nintendo. Without a license or permission, it is trademark or copyright infringement.
I agrée on this one. But i'm wondering where could ask the permission to copy?

ex: I would like to create a T-shirt with (lets say) "mike tyson" where or how could I get this permission? where would you search and know it's the right place to ask?

If you're referring to the Mike Tyson's Punch-Out!! game, you should probably contact Nintendo directly and ask about licensing opportunities.

If you want to use images of Mike Tyson's likeness, you should contact him directly (there is a contact for on his website, MikeTyson.com). Even if you get license or permission to use his likeness, you may also need to get permission from the copyright holder of the photos you want to use. And if you want to use images that include any championship belts, you may need permission from the respective boxing organization (WBC, WBA, IBF, etc).

I agree with Tim.
And, in addition, expect to PAY for usage, it won't be free. And that's IF they'd allow it. I highly doubt that Nintendo would.
