Switch Is and It in your question and you have your answer. Yes it would be stealing to use some one else's work ( whole or part) in your design. Trust your gut in this situations and do the right thing. That's the simple, non lawyer answer. I am sure others could give much longer and more specific answers.

There is always the parody ave. but for me it's not worth the risk.

Thanks for all your answers. It's always good to know what people know or think in order to make a move. Im trying to sell superhero tshirts without been illegal. Im making my own designs with out using the logos but a little help its always good. Bummer to know I cant use half of any logo.

For what it's worth, you can't use characters or names of superheroes either. Your best bet is to create your own characters. Basing a tshirt design on an existing character could lead to legal issues.

Yes, there are parody and fair use laws. But it still leaves a risk to be sued for infringement. IP owners always have rights to protect their work from being reproduced on salable goods without permission.
