I had an attorney check for the name that I want to trademark and all came back clear. He asked that once the t-shirts were printed to send him a picture of the logo. My tees are tagless so i sent him a picture of the logo on the rear of the shirt. Now he is saying that I can't trademark my logo, that it has to be on a tag. Then he said that if we are manufacturing the t-shirt we can take a picture of the brand and size in the inside & a picture of the shirt. However, if we are using other company's shirts the trademark is the manufacturing company example: Fruit of a loom, etc.

I need to trademark my name. What's the right way? I'm so confused, this is not what he said when we met.

Your Attorney needs to take a lay down and rest a while.
I did mine for 325 dollars myself.
Do it online USPTO
Basically you just need to establish date of first use of your logo
Then print a shirt with your logo and attatch that image and choose your category's for logo usage.ie clothing
Then state are you claiming design and text , text only colors etc and press the pay button give it 4 months and if all good you will be issued TM

Not sure why the attorney wasn't more clear when you first spoke with him. To be eligible for trademark, your logo must be used to identify the source of the goods. Simply printing the logo on a t-shirt is not enough, as the USPTO considers this use "ornamental." To show proper use on clothing, use the logo on a hangtag that you plan to affix to the shirts that you sell. This should resolve your issue.

You can do it without being on the tag or hang tag but it needs to be more than ornamental as mentioned. A left breast or sleeve size print on the shirt should be enough.

Be prepared for a rocky road though, we hit a lot of roadblocks with our TM before being able to get it through. the process took us 30 months.

Thanks for the input. I sent the attorney a picture of the inside w/the .com he said it'll work but if I just want the brand it'll have to be w/out the .com. I replied, that I will figure it out and to disregard.

I have another attorney to contact that I liked better but was a little more money. I will also check out what Limey said.
