i see alot of web site t-shirts companys using images with mona lisa,marilyn monroe, and elvis presley. i see where they redesign or add to the image. would this be copyright infringement. are would this images be in the public domain.
Works prior to 1923 are considered to be in the public domain. So I guess the Mona Lisa fits that guideline and usage would not be considered infringement.
Images of Marilyn Monroe and Elvis Presley are copyrighted by the photographer. Copyright is valid for the life of the copyright owner plus 70 years. So usage of an image without license or permission would be copyright infringement.
The estates of Marilyn Monroe and Elvis Presley own the rights to the respective name and likeness. So in addition to the copyright issue, license or permission would be needed from the estate just to use the name and likeness.
So to answer your question, some of what you are seeing on websites are infringement, but I'm sure some are legit licensed merchandise.
