That would be a big NO. It is not legal to sell shirts with that image on them. You would be stealing from the copyright/trademark holder. While it is a large company that probably has more money then they know what to do with...its still stealing none the less.

Its pretty easy to figure out....if you didn't design the art yourself you cant profit from it. With the exception of people bringing their art to you to make a shirt (or whatever) for them. Unless they bring you something like you posted...we are talking their own logos, test, photos, etc. Or when you buy art to use commercially.

Thank you for the replies but we did recreate this image I am just wondering if it is illegal because of the superheroes even in this position.
You cant redraw/recreate someone else art and then sell it.
You need to come up with your own design...so in other words... to make this shirt you need to create YOUR OWN superheros... so replace all the copyrighted ones in your image with your own made up ones (like Mediocre Man...instead of Super Man).

Unless you contact Disney to get a license to, you can not print Marvel superheros since Disney owns the rights! Warner Bros owns the rights to superman...so you need to contact them for a license for that. You can easily search google for the rights holder for all these characters so you know who to ask for permission to...oh yeah and most likely send a large check to them also.
Do you understand now?

Would the "parody" exception not work in this instance?
While there is an attempt at humor in the design, the characters are direct ripoffs of the original art. There is no real parody going on here. Even if there were, you can still be sued for creating a parody. So there is still plenty of risk involved.

I think you should give some thought to Mediocre Man, if Amw will release it. Guy of 5'10", thinning hair, slight paunch, bowed legs. A mild-mannered UPS guy. In his muscle suit with mask, no one has a clue who he really is. He's a total badass who is dreaded by of all those porch package thieves.
