That's not a product photo, so it could be anything. It's could well be opaque transfer paper, and probably won't look like that in real life. It's highly unlikely to be a legal use of the image (I'd say definitely not, but how could I know for sure?).

No, it's not legal to sell pictures of celebrities on t-shirts without permission.

Tupac's mom actually has a store setup at CafePress for official merchandise.

Wow! (off topic a bit) I've head good things about CafePress! I'm putting out a lot of music and video right now and am gettin' a crash course in copyright law and you are right. Did you know the Empire State Building is trademarked? :)
