I was wondering if anyone new about the Johnny Cupcakes vs Benny Frying pan case? If not, apparently some dude in Korea completely ripped off JC and called his company "Benny Frying Pan" . He didn't even bother changing many of the designs that Johnny brought to market.. Basically he just copied everything and started selling. You can do a quick google search on Johnny Cupcakes vs Benny Frying Pan for more info. If anyone knows how to prevent this sort of thing let me know!!

There's no way to "prevent" it.

Crooks will do what they want...laws and copyrights and trademarks be damned. All you can do is what Johnny did. Register your trademark/copyrights and defend them vigorously after the fact if you find someone infringing.

I guess things like this come with the territory. It just sucks that some people will not have the resources to fight/fly to Korea, and battle it out like JC. Even if you are TM'd (which I am) Lawyer cost/flight cost/ time lost.. I guess this is where the "cashflow" portion of your business should be strong and all these sorts of "what if's should be included in working capital.

It's all relative though. The value in creating the Korean knockoff is based on the value of the original brand. So it's because JC is so big that it was knocked off. If a brand doesn't make it big, then there's a smaller chance of them being knocked off. And if they are, the knockoff may never get big enough for the original to even find out about it.

As Rodney said, it can't be prevented. You can only register your IP and take action after the fact. With all of the mass production that is done overseas, this type of stuff probably happens far more than we ever hear about. Sad but true...

Personally, I feel like the more time you spend on a design / the more unique and hard to duplicate it is, the less likely it is to be knocked off.

Most of JC designs look like clipart, so all someone would need to duplicate their designs is a clear product image, and Adobe Illustrator.

Bet you'll never see anyone trying to knock this off:
