yea, not only is it the law it's the right thing to do.
using your example of martin luther king: imagine you were the photographer that planned/spent money/traveled/stood in the heat/got busted in the head by police(whatever) and years later you see your photo reprinted on a shirt. i know i'd be a little upset. -peace.
