i was wondering if this was legally ok- if you made a tshirt with a stock transfer design on it along with your companys logo somewhere on the shirt. either for resale or promotional giveways. just being on the cautious side.

If the stock transfers are licensed and you purchased them legitimately, then it's legal to make shirts and sell them. It's ok to include your own logo as well.

Just be careful not to market the finished product as "official licensed merchandise," because that could be fraudulent.

hm, i don't think 'stock' means public domain at all. there are companies that specialize in photo and film footage for movies. it's usually pretty generic images used to replace going on location and/or using an expensive model or scene. for example, you can shoot your movie on the back lot (if those still existed) in california, and use stock footage of times square in new york to establish the story location.

i was looking at some 'stock' pics the other day, and the prices ranged from $30-$99 for most of them, depending on the size and quality. off the net, they're usually watermarked and have some kind of anti-theft deal where you can't copy them to another file.

I do not have an answer but I know you can buy fabric and stickers of famous brands and/or characters and there is a note on the packages that they can not be made into goods that will be sold.....
Despite those disclaimers on the product or packaging, the First Sale Doctrine (in the US) would protect purchasers who use the licensed product to create items they resell.

Can IP owners still sue? Yes. But the first sale doctrine has been a successful defense in these cases.

That said, it is very important to understand that purchasing licensed materials does not transfer the license. So the end product is "made from licensed material" and NOT "licensed merchandise."

thanks everybody for replying. as i found some great answers. to put my question in a simpler way would be this. if i went to transfer express & got one of their ready made transfers . and put it on a tshirt along with a company logo. would this be ok.??
sorry if i wasn't clear and specific the first time.
