If you "hand crafted" the letters with your drawing/paint software, then, yes, the text would be art, and no one could copy your art. However, anyone could use the same words in any way they wish, as long as they didn't copy your actual drawing of the words.

Don't let concerns over people stealing your stuff prevent you from putting your stuff out where it can be seen by customers. Such worries delayed me in opening stores/shops in marketplaces that now account for most of my sales.

Set aside a little time once a month to search for theft, and file complaints when you find it. But reality is that if thieves can't see your product, then neither can customers

On a T-shirt, copyright protects the art only. T-shirts are not deemed a legitimate form of publication for the written word, and short quips/phrases are generally not open to copyright protection anyway (unless of course that quip was part of a longer copyrighted work, like Star Wars or The Big Sleep etc).

But you can't afford to go to court over this, and maybe they can't either, so how it sorts out if push comes to shove depends on how far each party is willing to push it.

I should be clear about something, though. I don't copy other people's ideas, and don't suggest that you do either. Here are a few reasons to consider:
  • It puts you in direct head-to-head competition for Search results with existing listings that already have rank, reviews, and accumulated SEO magic.
  • They may not take kindly to it, and there are ways to make life hard for people. On occasion, I've been tempted to get on an airplane and make it "hard" right on someone's face. I am very far from alone in that.
  • What value does it add for a customer beyond what is already available?

Someone came up with that Cat/Bone idea. It's a nifty idea. I've been thinking of and writing stuff like that down for over 40 years. I avoid looking at what others have done when I'm working on a design/idea because rather than help me, it just makes it harder to see my own ideas for the noise of theirs. You get more traction by bringing something new to the table than by being the next guy to copy the guy who copied that guy.

I agree with your saying, but I just feel it is fun way to create something from a funny saying because I like these funny sayings lol. It's just fits my personality. Thank you for your words of wisdom.

TESS is for checking trademark. While it is possible these people got a trademark on that phrase, that would be a misuse of trademark, as it is not their brand name or company slogan--rather, it is a product.

Select the Basic search on the TESS site. Enter the text in the TESS search field, select the Live option (as opposed to the Live and Dead option). You'll get a list of results, some may be exact matches, some may just be similar, or maybe no matches will be found. Click on the exact matches and see if Clothing or Class 25 are listed as protected classes.

Are you planning on selling on Merch by Amazon? If so, you might want to check out this Reddit: https://www.reddit.com/r/AmazonMerch/
Haha you are great. I just realized the cat sample i posted and then saw your avatar photo had cat so you must be cat expert too so i trust your judgement on this lol.

I just find it funny that some people on etsy threatened to sue me when I had a shirt that said "I love it when my wife when she lets me play video games" with the words "it when" and "when she lets me play video games" are in small print so it seems you are saying I love my wife. Apparently the etsy seller trademarked this and have no idea if she has 100% right too it or not? No graphics just slogan. And my design actually had graphics.. So was i out of luck then? Either way, the tess seems to be valid and good way to start. Thank you so much

So this particular design i found on amazon. "I found this humerous" tshirt with cat holding humerous bone (i guess that is what it is). I plan on doing my one take with my own style cat and bone that is like anime/manga style https://www.amazon.com/T-Shirt-Found.../dp/B07HJBSXLX

How would I go about finding this "LIVE" and "CLASS 25"

On here TESS -- Error

Seems there is lot of options and bit overwhelmed. If you can kindly give steps on doing so i would be forever grateful!

Re: snorg tees am i able to do own design with similar phrases

Check the TESS database (US Patent and Trademark Office). Limit your search to Live trademarks. Look for TMs that apply to Class 25 (clothing). Uhm, and to clarify, TMs are intended to protect the identifying name, slogan, logo of a brand ... not random sayings. But some people are filing frivolous TMs in order to get people kicked off of POD marketplaces. These TMs could be overturned in court, but a POD design is not worth the effort.

Snorg has quite a few designs that are "parody" (they would have to convince a judge that it should legally be considered parody if the IP owner files a complaint ... not something you or I can afford). Even Snorg would probably take such designs down in a hot second if Disney, or whomever, filed a DMCA compliant.

I would not copy anything Snorg is selling (or anyone else). Better to have your own original spin on a niche and build a following around that (repeat as possible with other niches). Besides actually adding value, you also avoid going head-to-head against much larger outfits with better SEO and an actual advertising budget.

Re: snorg tees am i able to do own design with similar phrases

I been doing tees for awhile now and ventured to do dropshipping as well and decided to get back to tees again as it was fun and nice to keep my mind off things.

I know snorgtees is fun creative shop and my tees were that kind of style in the past but wondering what are the copyright and trademarks of their phrases?

I see some are actually movie quotes etc and some are just everyday phrases.

I had thought everyday phrases were always non copyrighted or trademarked. Then when I used to sell on etsy there was some soccer moms who trademarked some terms and threatened to sue etc.. (or maybe crazy cat lady I dunno).

I just wanted to take some funny phrases and add my own graphic artwork and wondering if this is safe route to go?

And I remember there was trademark site to check these but I always thought that site was little to complex and not very definitive answer. Is there a site right now to see if phrases or quotes are copyrighted/trademarked?

Like I had a shirt that had "camping is in tents intense" and how would I even know if this is trademarked until I get some stop / desist letter etc..
