I used to work at a place that had security cameras, I could never catch the little buggers. But I was told by head office, that I could ban them from the store.
They would come in and I would stop them before they got too far into the place. Tell them they were not welcome in the store any more. If they asked why, I told them....every single one of them turned and never returned.
I dont know the leagalities of it....but it worked, and the theft in the shop decreased considerably.
if you've got them on video - capture a still of each little darling, blow it up and print letter size posters with 'shoplifters will be shot and eaten' or something clever - post them at the door (or entrance to your booth if you're in a flea market). they're sure to recognize their own mug shots and stay clear. if you're in a mall or flea market or other area with multiple vendors, pass some around! if they nailed you once coz you were distracted with a customer, they're apt to do it again if they get past the door!
legalities? well i really don't know....what are they gonna do, call the cops??
what are they going to do...sue you that is what... there was a case in New York I think...where the deli owner posted a photo and bad check...he lost and had to remove
maybe....but they could hide and watch me counter-sue for damages.....in my former life in the insurance industry i had the particulary distasteful job of settling a claim from a burglar....who had broken his leg when fleeing the premises, tripping as he vaulted over a railing which surrounded the elevated dock steps. sadly, people can and DO sue for anything these days. it still wouldn't prevent me from doing what i felt was right to protect myself and my business and the devil take the hindmost.
I have video and I had the stills blown up and posted in the store. If they do come back I will definitely let them know they are no longer welcome in the store and why. And if they want to discuss it further, then I will let them stay and we can all discuss the video with the police.
