It's sad that we're so afraid of litigation that anyone could be uncertain whether or not they could use the leaves in their own backyard in their artwork
There are hundreds of thousands of pictures that are available for scanning look for the copyright either in a book on the cover or on the back about pictures in a book. I own a book that features 1920 advertising and all are legal to scan and print because of the 70 year rule plus I checked to make sure. I am not condoning using anything that might be owned by someone else but if your doing one shirt for yourself it may be OK, but don't set yourself up for any type of lawsuit by going beyond that point.
I trew some beads on the scanner and scanned them... and they looked pretty cool... I printed it out and pressed it on a test shirt and it looked neat.
So after that I got "scanner happy"
I would suggest you get your ducks all in a row. I think you can own the tree, but the leaf is a product of the tree owned by the tree. i think the tree would need to sign the model release unless the leaf is a adult. This is just my 2 cents, I doudt it's even worth that.
