if i get someone to create a t-shirt design for me... and i pay them money for it... the design is now mine.. how do i copyright it so that no one else can use it???
and do i need a contract saying XXX person designed this image for me and was paid XXX dollars and transfered the rights to me..

You need to get the artist to sign off on transferring the copyright to you. Just because you paid doesn't *automatically* transfer the copyright to you.

You certainly need something from the designer saying they actually created the design. Even top flight designers have been known to copy other peoples designs.
What you don't want is someone accusing you of stealing their copyright design. The one downside to using designers, is you can never be one hundred percent certain it is their own original work you are putting your name to.
How do you know if an image has a license agreement or copyright attached to it?
I got an image from the internet that I am considering using for one of my tshirts for the fall collection but now im not sure :S

The person who takes the photo automatically has a copyright on it as soon as it is created. It does not have to be registered.
So unless you took it, or obtained permission to use it, you don't have rights to use it. I would recommend going to a stock photo site and purchasing photos, just check the license agreement before you buy.
