Post Outsource your custom Designs - Issues.

Hi,

I was wondering if anyone has had any issues with Outsourcing their designs ready for press? I am a little curious if there has been any issues with vendors keeping, re-selling or even selling their designs.. It's probably a dumb question but some are very protective on their designs and I think we all would hate it if they found one of their designs up for sale without their permission. I have little knowledge with copyright and what not.
Has anyone in here made any arrangements with a vendor outlining not to sell, re-use, or even give sample's of their designs (sample pack) to other people in the business? Has anyone gone to great lengths in even having a contract written out? Do you think this is the right approach or is there another way of re-assuring yourself your design will not find itself in any other place?

If you are contracting out your work to a graphic designer, you can include how the finished image is allowed to be used in the final contract.

Generally speaking though, graphic designers don't sell your unique design to someone else. They wouldn't have much repeat business if they did that.

But to help set your mind at ease, you can include that the design isn't to be reused in any contract you write up.

There are some graphic design contracts that have been posted here in the forums that can be found in the search. There's also some sample ones that can be found in Google.

Hi Rodney, you are right if a graphic designer does sell another's design they wouldn't get much business.

What if I'm outsourcing my designs to have it printed onto transfer material? I am sending out the finished design in ai or eps to be made ready for press... Do you think if I asked my vendor to sign and agree on a contract he/she may get offended? I was told that if they come across good designs they print off a few more and keep them aside and also include them in sample packs.

What do you think?

we've been doing outsource jobs since 2000
and there are times that we signed out the
the designs to the client after the project is
finished and approved. we have no problem
with that... as long as the client tells us before
we begin the project or even before we give
the quote.

of course the price of the design with transfer
of rights is higher than that of just getting the
final result without owning the rights.

Hi B1aze5,

Thanks for your info, can you please clarify to me my understanding; from my understanding is that you accept outsourced designs by printing these for your clients with no problems in signing an agreement relating to copyright and or other related issues. However the result in owning the rights to the designs you had produced for your clients incurs a higher fee.
Sorry it's been a long day and my brain is overworked!..

Tizz, my company only does graphics work.
I'm here in t-shirtforums.com because i want
to start printing my designs...

We have clients that request full transfer of
copyright to the design and we do sign-out
those designs at higher fees.

If you PM me i can send you to the sample
sites and previous works we did with full
transfer of rights...
