I received a request from a reseller to print up a dozen shirts with the Obama Joker picture on it.

I told him I didn't think it was legal. Even though he is a public figure the artist's graphic isn't.

He said since he was going to be the one selling them that he would be taking the heat. He also added the artist doesn't seem to be coming forward and the shirts are already being sold at CafePress.

Any opinions?

I don't think it is legal. But if your still wanting to do the job, write up a contract that makes him fully liable.

Regardless if you do that, it still doesn't sound legal just by what you just said.

Oh and the classic answer to this situation, a lawyers advice is needed.

Does the shirt being sold on CafePress make it legal or ok? No.

Will he be the only one "taking the heat" if someone with the rights decides to get sue happy? No, because you would also be profiting from it by printing it. Sometimes they go after anyone with pockets or anyone that profited.
