just checked johhny cupcakes website, and got discouraged :(
wow is all i can say ..hes done very big things with his brand...now he even has celebrity endorsements...i have to say i feel very discouraged after seeing all that
on a side note, isnt it illegal to use other logos on his shirts? for example he has a wu-tang clan shirt..it has the wu tang "w" but instead of wu-tang it says "cu-pcakes"
and he also has an "air johnny" shirt instead of air jordan...i thought stuff like this was illegal??
anyway im very discouraged any1 else feel this way?

Some parody is legal some is not. But it's best to consult a lawyer for some true advice on this one. And am i discouraged for what he's doing? No, he actually got me more motivated, if a t-shirt with a fruitcake, cupcake, bread could really sell, then i don't see a problem with me starting a clothing company selling t-shirts with a graphic piece of steak printed on them. lol

Actually, that's not always true (which is why it's good to try to avoid legal advice in forums).
Parody on merchandise for sale has not always held up in the courts as legal use of parody.
Somehow they draw the line between Saturday Night Live parody and when you start selling t-shirts with a parody image on it.
Do people still do it, sure. Can they get sued and lose a lot of money, yes.

How do people get away with it? We have no idea what is going on behind closed doors in a company. Could be lawsuits pending, could be laywers on staff fighting it, could be flying under the radar until a lawsuit happens, could have actually asked permission.

Why would you feel discouraged? He started small and worked his butt off to grow his business, something we all have the potential to do. You should be inspirited at the possibilities. He took a simple, slightly wacky and and executed (read: marketed) the heck out of it to make it a success.

Just the opposite. It encourages and motivates me. Just think, if he can do what he has done/is doing with a silly cupcake, think what you can do with your brand.
