Do I need to copyright my design in every color?

Default Do I need to copyright my design in every color?

Thanks to the great information on this site, I was able to figure out where to go to apply for copyrights for my designs. Each of my designs will be available in different colors and might have other slight variations. Will they still be covered by the copyright? Thanks!

Yes, they'll be covered.

People can't make small changes to your design and then sell it as their own (changing your red parrot to blue for example), so if they copy a different version of the design than the one you copyrighted (they copy blue, you registered red), it won't protect them. A court isn't so stupid that they won't see the red parrot and the blue parrot as the same thing.

That said, if you expect to do colourways, maybe you should submit a few different colourways with your copyright registration. It's not necessary, but it's easy and can't hurt.

honestly, copyright is a waste of time/money. people are going to rip your artwork off legally if they really want to. instead, invest in a good trademark attorney and file a federal trademark with the USPTO. if you protect your brand name and sell high quality, original artwork on your brand, you will always be 1 step ahead of those ripping you off.

the bottomline is that people can legally steal ideas and sell them as long as the artwork isn't copied. i've had my work ripped off too many times to count but i'm flattered by it and sleep easy at night because i built a well-known brandname that can outsell my competitors' cafepress, ebay, knockoff whatever.

According to USPT office, it is best to trademark in b & w this will allow you to use all colors and fonts. If you select a specific color then you are stuck with only those colors.
