Default Printing A Trademarked Logo WITH Permission

Hi All -

I'm printing t-shirts with a corporate sponsor on them. A company has agreed to be a sponsor and as a result will have their logo printed on the back. Is there any documentation that I should ask for to protect myself in the case that there is any confusion (in the future, from the gov., from the company, whoever...) about my legal right to print that logo?

Is there a standard form to get from a company when you reproduce their logo with permission?

I would have them sign a basic release form that states that they give you permission to reproduce the image, they will hold you harmless from any legal action taken against them for the image, and they will cover any fees, fines or other outlay that you may incur by using their image.

You're not profiting off the resale of the shirts, you're just profiting off the print service you provide. There is really no infringement going on here. And as I'm sure you know, you don't have any right to print their logo for anything other than what they order from you.

But if you want to, you can just draw up a simple document that says you are allowed to print the logo for them and have your contact at the company sign off on it. And if a document seems to formal, just have them send you an approval e-mail or maybe a fax approval on the artwork.

Just send them a proof to sign off with the disclaimer 'the client authorises' etc. added to the bottom.

I would suggest that you always get it in writing.

Some local offices may approve of it but then
the "home office" has no idea and doesn't
allow it.

This happened with Disney once and the legal
team was on it like white on rice.

If it is a trademark registered at the federal
level be sure to add the (R) symbol in the proper place.
