Default Is it legal to print a word/phrase on another brand's shirt?

So my concept is for customers to choose a brand of t-shirt or underwear from my website and then I will print a word/phrase on the product. Does anyone know if this is illegal because I'm printing something on an existing brand. For example, if a client chose a Calvin Klein t-shirt and wanted the word "Star" printed on it, is that ok? Can I also print the logo of my company on the outside as well?

I know that many companies print on Amerian Apparel shirts but not sure if you have to obtain some sort of contract with each brand you plan on printing on.

Thanks for any guidance you can give me!

There is definitely a fine line here. Companies like American Apparel, Gildan, etc, know that their shirts are being printed on and sold as a different brand. Companies like Calvin Klein, Under Armour, etc, expect their shirts to get to the consumer as they produced it.

Usually, you have to be an official reseller of brand like CK or UA for them to sell to you. So if you are legally purchasing the shirts from the company or official distributor, and you have the proper tax id and resale license, then you may be able to do this. But you should probably be very clear how you market the shirts, that the decoration on the shirt is being done by you and not by CK.

Since I'm not an attorney, you should probably contact one to make sure all this is ok.

Thanks for your help! Do you happen to know anywhere to buy unbranded underwear to brand myself or I would have to get it manufactured?

American Apparel has underwear, but you would need to remove their label and add yours. Or you can do a custom/private label program through just about any supplier, sourcing company or directly through a manufacturer.
