Do I need concent to put a picture of a person on one of my company's shirts?

Default Do I need concent to put a picture of a person on one of my company's shirts?

DO I need concent to put a picture of a person on one of my companies shirts? I want to put a picture of Jane Fonda with sunglasses on, on one of my shirts. Do I need her concent? Also my friend says he has researched it and there are shirsts making fun of famous people who dont get concent.

Also is there any place were I can have long sleve button ups made for me?

Where are you going to get the picture of Jane Fonda from? Is it one that you personally took or are you buying it from someone?

Yes, you do need consent. It's called Right of Publicity. You cannot profit off of someone else's name or likeness without license or permission.

No, it's not. Any image you find on the internet is copyrighted by the owner of the image. You would need to negotiate license or permission to use any photo you find.

There are a lot of people doing a lot of things. Not all of it is legal.

In this particular case, there are two issues you need to be aware of. The copyright of the image you intend to use, and the right of publicity of the person in the photo.

You need to negotiate a license to use the image. And you need to negotiate a license and/or royalties to the person in the image. So start by contacting the owner of the image and the person in the image (or their attorney).

It's probably not going to be an easy process. And be prepared to come to the realization that you probably won't make enough money off these shirts to make all this effort worthwhile. It's a lot easier and a lot more profitable to create your own original artwork instead of using someone else's images or name and likeness.

Tim is right on mark on both accounts.

Here's a pretty good read describing exactly what "Right of Publicity" means if you want to look into it in more detail.

RIGHT OF PUBLICITY

As for images, if you didn't create it you can't use it without permission from the person that did create it.

As for your next steps...I think you're probably going to have a pretty hard time getting Jane Fonda to agree to a t-shirt with her image on it if you're planning on poking fun of her on it.

Well thanks. Well now I was looking at trendyblanks (a place to get aa shirts) and they are like 17 dollars a piece. So were can I get amreican apparel shirts for cheaper?

You would need to register a business account with American Apparel to order wholesale. They only sell to custom t-shirt printers, so make sure that fits who you are. You can also order blank t-shirts from one of their distributors like TSCApparel (you'll still need to register a customer to see the wholesale pricing)
