Default web sites with similar names?

I have been working on my web site and did a search on domain names and ran in to someone elses site that has the same company name there site name is the same as mine but i have a #1 after the name. I was wondering is it still ok for me to use the name we are in separte states but if i use that name we will probally show up on the same searches. I am trying to figure out if i have to change my company name. Any input would be appreciated.

thanks
Brian

There are lots of companies with the same or similar names in different states or in different industries.

Are you both in the same industry?

You may lose visitors if people don't type in the 1 after your name, but you might want to check a trademark search to see if the name you're using is trademarked.

Default Re: web site?

thanks for the reply, yes they are a screen printing company i am doing transfers at this time but will move to screen printing in the near future my web page is in progress at this time but i just recently had the domain name changed the #1 isnt in the actual name of the company it is just added to the domain name. I am going to have to do some more research on the leagle issues of using the same name at this time i dont think it is much concern as i am only doing this part time but as i grow it may become an isue.
Thanks

Sounds dangerously close, and either way the domain seems unlikely to be a good one if it has a 1 arbitrarily tacked on the end.
