This section of the forum is for discussing the business and finance issues of the t-shirt industry. Which business structure to use (sole proprietor, LLC, S Corp, etc), how to handle billing, where to register your business and get the proper licensing, etc.
I will start off by explaining how my business is set up. I'm going to use fake business names for this question. This should be a good one for Greg.
I operate a single business as an LLC. I have two extra DBAs under that business. I sell clothing under one of those DBAs.
Lets say that my business is registered as CSC Shell Company, LLC at the state. I sell clothes with a different DBA (lets call it Super Sweet Clothing) under that business (CSC Shell Company, LLC). Super Sweet Clothing has it's own website, and is only tied to CSC by the CSC Portfolio, and by billing.
I just so happened to search online and there found a trademark for CSC - for Clothing, namely, shirts, tops, t-shirts, and tank tops.
Should I have to worry about their trademark? I am not selling clothes as CSC, only as Super Sweet Clothing.
Ask away, but you won't be able to get any legal advice worth anything from us. You'll need to speak to an IP attorney for that. Your question seems pretty straightforward, so it shouldn't cost you much at all for that. Most lawyers will do an initial consultation for free or very cheap.
Jasonda, thanks for responding! Good advice. I know that most legal and financial answers on any forum can only be taken at face value. I probably will end up taking a few questions to a lawyer, anyways.
I am still interesting in hearing the personal opinions of the members of this forum, though. Keep em coming!
It could be a problemif you ever start using the initials - if they want to make a fuss they might be able to - I would not worry unless you are making lots of money -
Can you sell a T-shirt with a phrase mentioning a politician, not libelous or slanderous and not get sued or have to give your profits to the candidate?
