Okay..I finally created my logo and name but I wonder if what im doing is legal....lets say for example there another trademark called Cool Cats...and I wanna name my Kol Kats could i do that?....(them are random names)..both trademarks are in the same industry

Yes, you may run into a problem.

If they are phonetically the same, then the chances are very low that you will be granted the mark.

Part of the reason for registration is meant to alleviate confusion in the marketplace and 2 companies with names that are pronounced exactly the same (even though spelled differently) would certainly cause confusion.

If it is something that you want to pursue, I would suggest consulting with an attorney.
